Fathers rights?

a friend of mine is thinking off divorcing his wife but they have a 1year child together, his wife is really bad and abusive hes a vey soft guy and loves the child so ignores her,is there anyway he can get custody of the child at that age.the childs mother has smacked the baby before, can this be used against her.what are fathers right over custody.
